Why buy title insurance in the current depressed real estate market?
If you look at why buy title insurance you get a good overview of the reasons why the one time charge for a title insurance policy is money well spent. However, I continue to run into people who think it is a racket because in their perception there aren’t that many title insurance claims.
When done properly the process by which title to a property is examined, a commitment to insure is issued to a purchaser or lender, the various exceptions are reviewed by the purchaser or lender, and policy issued, serves not only an “insurance” function, but also a “due diligence” function. The buyer, or lender, knows what easements, covenants, and encumbrances exist as far as one can tell from the local land records. This means that every issue is identified, and disclosed. An informed decision can therefore be made to go forward with the transaction, or not to proceed.
